Data Processing Consent Term (LGPD)
By accepting these terms, you explicitly consent to SKDScribe processing your personal and sensitive data (such as voice and audio content) in compliance with Law No. 13,709/2018 (Brazilian General Data Protection Law - LGPD).
1. Purpose and Scope: Data processing is conducted strictly to provide the contracted service, which encompasses automated audio-to-text transcription, multilingual translation, Artificial Intelligence summaries and mind maps, platform editor availability, and customer support for your account.
2. User Intellectual Property: The User is the sole and exclusive owner of all copyright and intellectual property rights regarding uploaded audio files as well as generated transcripts, translations, and summaries. SKDScribe claims zero ownership rights over your input or output content.
3. AI Accuracy and Limitations: Transcription, translation, automated summaries, mind maps, and analytical services are generated using Artificial Intelligence technologies and may contain inaccuracies, contextual errors, or omissions. The User acknowledges and agrees that these features serve strictly as productivity support tools, and it is the user's sole responsibility to review, edit, validate, and correct generated content directly within the platform prior to any official, academic, commercial, or legal use, releasing SKDScribe from liability for decisions made based on generated outputs.
4. Zero Training Guarantee: Your audio files, transcriptions, and personal data will NEVER be used, shared, or commercialized to train or improve public, proprietary, or third-party Artificial Intelligence models.
5. Strict Sharing and Security: SKDScribe securely and temporarily shares audio files and text data in encrypted transit with partner AI providers solely to process requested transcriptions, translations, and summaries, under strict confidentiality and security obligations, without storage for third-party model training.
6. Acceptable Use Policy (AUP): It is strictly prohibited to upload audio containing unlawful or defamatory material, violating privacy rights, trade secrets, or wiretapping and eavesdropping regulations. The User warrants possessing express authorization from all participants whose voices appear in recordings, assuming full legal responsibility.
7. Plans, Billing, and Cancellation: Paid plans operate via recurring subscription with automatic renewal for the contracted billing cycle, securely processed through Stripe. The User may cancel subscription renewal at any time directly from the dashboard. The statutory 7-day right of withdrawal from initial purchase is guaranteed.
8. Retention, Archival, and Permanent Erasure (Right to Erasure): Transcriptions may be deleted at any time by the user. Upon requesting account deletion, a 30-day security archival grace period applies following the end of the current billing cycle, followed by the physical, permanent, and irreversible erasure of all data and files from servers and cloud storage.
9. Data Subject Rights (LGPD/GDPR/CCPA): You have the right to request confirmation of processing, access to data, correction of incomplete or inaccurate data, portability, revocation of consent, and simplified erasure through official platform support.
10. Non-Commercialization of Data (CCPA / LGPD): SKDScribe DOES NOT sell, rent, or trade personal data, voices, or transcripts of its users to third parties under any circumstances.
11. Legal Age, Jurisdiction, and Severability: The service is intended for individuals aged 18 or older with legal capacity. These terms are governed by the laws of the Federative Republic of Brazil, specifically the Marco Civil da Internet (Law 12,965/2014) and the LGPD (Law 13,709/2018), electing the competent forum to resolve disputes. If any provision of these terms is deemed invalid or unenforceable by a competent judicial authority, the remaining provisions shall remain in full force and effect.
